You must be 16 or older to have an account here. We ask your date of birth once, at sign-up, for that reason and no other.
Give us a real name, since it is what the people on your trips will see. If you signed up with a password rather than with Google, keep it to yourself. What happens under your account is your responsibility.
You own every photograph, film, voice note and word you post. Posting it here does not give us ownership of it, does not give us any exclusive right in it, and does not stop you doing anything at all with your own work anywhere else.
We are storing your photographs and films for you and showing them to the people you chose to show them to. That is the entire relationship.
So that the app can work at all, you give Laserdive LLC permission to store, copy, resize, re-encode, transmit and display what you post, for one purpose only: running Sequoia Goes West and showing your content to the people you posted it to.
That permission is:
It does not let us sell your photographs, license them to anybody else, put them in advertising, use them on our website, put them in App Store or Google Play screenshots, or use them to promote the app.
If we ever want to do any of that, we will ask you first, about that particular photograph, and you can say no. Saying no changes nothing else about your account.
When you post to a trip, everybody on that trip can see it, and so can anybody they later let in. When you post to somebody else's trip, you are putting something into their album.
⚠️ And a trip can be Public, which means anybody at all can see it, signed in or not, because it is listed on its owner's profile page for anyone who opens it. New trips start Public. Whoever owns the trip chooses that setting, so on somebody else's trip it is their choice, not yours. Look before you post.
That is the point of the app, but it is worth being clear about: a trip is not private to you. Do not post something to a shared trip that you would mind the other people on it keeping, or the world seeing if it is Public.
You can delete your account yourself, from the You screen inside the app. We ask you twice, and the second time you have to type the word delete, because none of this can be undone.
When you delete your account:
Comments other people wrote on your photographs are deleted with them. Their words were about a picture that will no longer exist.
Deleting takes your photographs out of trips other people were on. If you posted most of the pictures on a trip you took with a friend, their record of that journey will be much emptier afterwards. We think your photographs are yours and should leave with you; but it does affect somebody else, so it is worth knowing before you press it.
Afterwards, nothing of you is left. If you sign up again later, with the same email address or another one, you are a new person here and nothing from before comes back.
Don't post anything illegal. Don't post other people's work as if it were yours. Don't post photographs of people who have told you they don't want to be photographed, and don't post anything designed to harass somebody.
If you post something you had no right to post, that is on you, not on the people who let you into their trip.
If something posted here is illegal, or somebody tells us it infringes their rights, we may remove it. If your account is used for that, we may close it. We will tell you why unless the law stops us.
Sequoia Goes West is a small app made by one person. We try hard to keep it working and to keep your photographs safe, but we cannot promise it will never lose data, never break, and never be unavailable.
Keep your own copies of photographs that matter to you. This app is a place to share them, not a place to store the only copy.
To the extent the law allows, we are not liable for indirect or consequential losses. Nothing here limits any liability that cannot lawfully be limited.
If we change these terms in a way that matters, we will ask you to accept the new version the next time you open the app, the same way you accepted this one. We keep a record of which version you accepted and when.
The app costs nothing to use today. If that ever changes, it is exactly the kind of change this section is about. We would tell you, and ask you to accept the new terms before charging you anything.
Small corrections, a typo or a clearer sentence, we will just make.
These terms are governed by the law of the State of Washington, in the United States.
